Terms of use

These Terms of Use ("Terms") form a binding agreement between you and B&R Enterprises ("we", "us", "our"), the sole owner and operator of Clay Buddy™ (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The service
Clay Buddy is a hobby-grade scorekeeping tool for sporting clays, skeet, and trap. It is provided as a convenience for recreational shooters. It is not shooting instruction, firearms guidance, safety equipment, competition-grade officiating, or a substitute for certified range officers.
2. Eligibility and your responsibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are solely responsible for your conduct at any shooting range, including compliance with all range rules, applicable laws, and safe firearm handling practices. Nothing in the Service authorizes, encourages, or is a substitute for safe firearm handling training.
3. Acceptable use
You agree not to:
- use the Service for any unlawful purpose;
- attempt to interfere with, disrupt, reverse engineer, or gain unauthorized access to the Service or its underlying systems;
- submit content that is unlawful, defamatory, harassing, or infringes another person's rights;
- use the Service to impersonate another person or misrepresent your affiliation with any person or organization.
4. Your content and data
You retain ownership of scores, session names, and any content you submit. You grant us a limited, worldwide, royalty-free license to host, store, transmit, and display that content solely to operate the Service for you and any squad members you share a session code with. You are responsible for backing up any data that matters to you; the Service is provided without any data-preservation guarantee.
5. Intellectual property
The Service, including its name, logo, design, and code, is owned by B&R Enterprises and is protected by copyright, trademark, and other laws. "Clay Buddy" and the Clay Buddy logo are trademarks of B&R Enterprises. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written permission.
6. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not warrant that scores, leaderboards, or any other output are accurate, complete, or suitable for competition use.
7. Limitation of liability
To the maximum extent permitted by law, in no event will B&R Enterprises be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service, whether based on warranty, contract, tort, or any other legal theory. Our aggregate liability to you for any claim arising out of or related to the Service will not exceed one hundred U.S. dollars ($100).
You expressly acknowledge that firearm sports carry inherent risk and that you assume all such risk. B&R Enterprises is not responsible for any personal injury, property damage, or other loss arising out of activity conducted while, before, or after using the Service.
8. Indemnification
You agree to indemnify, defend, and hold harmless B&R Enterprises from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms or any applicable law.
9. Changes to the service and to these terms
We may modify, suspend, or discontinue the Service or any part of it at any time, without notice or liability. We may update these Terms from time to time; the updated Terms take effect when posted. Continued use of the Service after changes means you accept them.
10. Governing law
These Terms are governed by the laws of the United States and the state in which B&R Enterprises resides, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in that state for any dispute not subject to arbitration or small-claims court.
